The present conditions govern the booking and provision of services offered on AssermentationPro.ca. They were written to clearly explain how the service works, Assermentation Pro’s commitments, and the information the customer needs to provide.

By checking the acceptance box and confirming payment, the client acknowledges having been able to read, keep, and accept these terms and conditions as well as the Cancellation, rescheduling, and refund policy.

Object and scope of the terms

These terms and conditions apply to remote commissioner for oaths services sessions booked and paid for online through the website or the associated booking platform.

The details specific to the selected service—including the estimated duration, the number of documents, the number of declarants, the price, and the time slot—are those displayed before payment is made and included in the confirmation sent by email.

When a mandatory rule provided for by applicable laws offers broader protection to the client, that rule remains applicable.

Assermentation Pro can receive a oath or a solemn declaration remotely by videoconference on appointment.

The service may include the administrative preparations necessary for the session, the use of videoconference and electronic signature tools, and the delivery of the finalized document.

Role of the Commissioner and Nature of the Intervention

The commissioner receives the oath or solemn declaration from the declarant, verifies the individual’s identity for the purposes of the hearing, and confirms the signature provided on forms appointment and completes the section reserved for the commissioner for oaths.

This service does not constitute a notarial act, a certified true copy certification, document authentication, or a legal drafting or advisory service.

The commissioner may suspend or refuse to conduct the hearing when the essential conditions for validly receiving the oath are not met, particularly when the identity cannot be satisfactorily established, when the declarant is unable to freely express his or her will, or when the document does not permit asoathation in its current state.

To avoid any delays, please prepare a complete, unsigned document and an original, valid government-issued photo ID.

Reservation and conclusion of the contract

The booking process generally includes the following steps:

  1. Service selection and available time slot;
  2. registration of necessary information for booking;
  3. Presentation of the total price and applicable conditions;
  4. Acceptance of terms and payment;
  5. sending a confirmation email.

The contract is concluded when payment is accepted and the booking confirmation is transmitted. The customer must immediately check the information on the confirmation and report any errors without delay.

The booking confirmation, these terms and conditions, and the refund policy can be saved or printed by the customer.

Pricing, Taxes, and Payment

Prices are listed in Canadian dollars. The total amount due, applicable taxes, where applicable, and the items included in the service are displayed before payment is confirmed.

When a fee is charged for the oath service, it is applied in accordance with the authorized rate. The other amounts listed, where applicable, correspond to additional services clearly described at the time of booking, including online booking, administrative processing, technological tools, and electronic document transmission.

Full payment is required to confirm the appointment. Payments are processed by a secure payment provider. Assermentation Pro does not store full credit card information.

A rate change applies only to future bookings. The price of an already confirmed reservation remains the price accepted at the time of payment, unless a change requested by the client alters the booked service.

Client preparation and commitments

So that the session proceeds effectively, the client agrees to:

  • Provide accurate and complete information when booking.;
  • provide the requested document in a readable format by appointment;
  • fill out the document without signing it in advance;
  • be present and available at the reserved time;
  • have access to their email during the session;
  • participate in an environment that allows for clear and confidential communication;
  • Follow the instructions for receiving the oath and signing it.

The client remains responsible for the facts they declare, the accuracy of the information they provide, and the choice of document or form they submit.

ID and identification of declarant

Each declarant must present during the videoconference an original, valid government-issued photo ID. The ID must be clear enough to allow for identification of the person applying for oath.

An expired document, a photocopy, a photograph, a screenshot, or a document belonging to another person does not replace the original required document.

When identity cannot be satisfactorily established, the assermentation cannot be completed. The consequences for the appointment are then those provided for in the Cancellation, rescheduling, and refund policy.

Videoconference and Technical Requirements

The client must have a functioning phone, tablet, or computer with a camera and microphone, a stable internet connection, and access to email.

The platform used must allow the commissioner and the declarant to see and hear each other simultaneously, view the relevant document, and ensure the integrity and confidentiality of the process.

Customers are encouraged to test their device and the video call link before the appointment. A serment session conducted solely by phone, without simultaneous video, cannot be performed as part of this service.

Documents, déclarants, and Reserved Service

The client must select the service that corresponds to the actual number of documents and declarants. Each declarant must attend the session in person, present their own id or swear an oath, or complete their solemn declaration, and sign at the designated time.

Documents or déclarants that exceed what is included in the reservation may require an additional reservation. The duration of the appointment cannot be automatically extended when another appointment is scheduled to follow.

If a document is incomplete, illegible, signed in advance, or cannot be used in its current state, the commissioner may request a correction. If the correction cannot be made within the allotted time, a new reservation may be necessary in accordance with the published policy.

Signature and transmission of the document

The declarant form must be signed during the session using the specified procedure. A electronic signature form may be used if it establishes the signatory’s identity and confirms their consent.

After the oath has been completed and the section reserved for the commissioner for oaths has been signed and finalized, the document is normally sent by email or via an electronic link, usually in PDF format.

The client must promptly review the received file and report any errors attributable to the section completed by the commissioner. A correction of this nature will be made free of charge. A change to the content declared by the client may require a new session.

Cancellation, postponement, delay, and refund

The Cancellation, rescheduling, and refund policy is an integral part of these terms and conditions.

  • A request received at least 24 hours before appointment may result in a free rescheduling or a refund, minus non-refundable transaction fees, where applicable.
  • A request received less than 24 hours before the appointment is not eligible for a refund or rescheduling.
  • The commissioner remains available for five minutes after the scheduled time. After this period, the slot is considered used.
  • The absence of an acceptable id, an incomplete document, or a technical issue on the client’s end does not entitle the client to a refund or an automatic postponement.
  • If a problem caused by Assermentation Pro prevents the service from being provided, a free rescheduling or a full refund will be offered.

The client is invited to consult the full policy before confirming their reservation.

Service unavailability and exceptional circumstances

If a failure, unavailability, or circumstance beyond Assermentation Pro’s reasonable control prevents the appointment from taking place, the customer will be notified as soon as possible.

Priority is given to a fee-free deferral. When the service cannot be rendered within a reasonable timeframe, a full refund may be issued in accordance with the applicable policy.

Personal information and privacy

Personal information, documents, and contact details provided are used to manage the booking, prepare and conduct the session, process payment, communicate with the client, and comply with applicable administrative obligations.

The customer authorizes Assermentation Pro to temporarily use the documents provided solely to the extent necessary to provide the service. The practices regarding the collection, use, retention, and protection of information are described in the Privacy policy.

Intellectual Property and Model Usage

The texts, graphic elements, logos, tools, pages, and original content of the site are protected by applicable intellectual property laws.

The template declarations offered for download can be used and adapted by the customer for their personal or internal needs. Unless written permission is granted, they may not be resold, published as a competing library, mass-distributed, or presented as the original content of another service.

Documents originating from public bodies or third parties remain subject to the rights, conditions, and versions established by their respective authors.

Service Responsibilities

Assermentation Pro is committed to providing the reserved service with care, punctuality, and professionalism, in accordance with role of the commissioner for oaths and the information provided at the time of booking.

The client is responsible for the content of their declaration, the accuracy of the information provided, the version of the form used, their technical equipment, and the transmission of the final document as part of their process.

Assermentation Pro is not liable for any consequences resulting from inaccurate or incomplete information provided by the client, changes made after the session, loss of access to the client’s email, or use of the document in a manner other than that intended.

None of the provisions of these terms exclude any liability or right that cannot be legally excluded.

Electronic communications

The customer agrees to receive via email or text message any communications necessary for their reservation and the provision of the service, including the confirmation, reminders, the videoconference link, requests related to the document, the signature link, and the finalized document.

The client must provide an accurate email address and phone number, and check their messages, including their spam folders. Non-essential commercial communications, where applicable, are managed separately according to applicable consent choices.

Governing Law and Dispute Resolution

These terms and conditions are governed by the laws applicable in Quebec and Canada.

In the absence of an agreement, any recourse may be brought before the competent court according to the applicable rules. No exclusive territorial jurisdiction is imposed on the client by these terms and conditions.

Modification of conditions and contact

Assermentation Pro may update these terms and conditions to reflect changes to its services, tools, or applicable requirements.

The version applicable to a reservation is the one presented to the customer at the time that reservation is confirmed. A subsequently published modification does not retroactively change the terms of a reservation already concluded.
